SIMILAR, not identical.

That is the standard the US Patent and Trademark will use when evaluating whether or not you should get trademark protection.

That means that even if they find something out there that is not exactly the same as your name/logo/slogan, and it might not even be in the same class of goods (aka-you sell different things), they can still deny you of your mark because your name is too SIMILAR to the mark already registered.

That is why it is so important to do a search before you file your application. The search should be more than just looking for an exact match on the USPTO website and seeing if the domain is available, but truly scouring the web for anything that is similar or "sounds like" what you are wanting to trademark.

This can be a tedious job but is something that can ultimately save you time and money in the long run by not wasting your money filing an application that will obviously get refused.

When I search, I not only do a human search but I also use a detailed (and expensive) program that uses an algorithm to help us narrow down even further the chances of your mark getting registered.
